By accessing or using Escape Room Studio ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By creating an account or using our Service, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.

Escape Room Studio is a software-as-a-service platform that provides escape room management tools, including but not limited to:

• Game management and control systems
• Puzzle and clue organization
• Player communication and monitoring
• Analytics and reporting
• Team and user management

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

3.2 Account Responsibility

4. Subscription and Payment

4.1 Subscription Plans

The Service is offered on a subscription basis with different pricing tiers. Subscription fees are billed monthly or annually based on your selected plan and the number of rooms you manage.

4.2 Payment Terms

By subscribing to the Service, you agree to pay all fees associated with your subscription. All fees are non-refundable except as required by law or as otherwise stated in our refund policy. We reserve the right to change our pricing with 30 days' notice.

4.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled. You may cancel your subscription at any time through your account settings or by contacting support.

4.4 Free Trial

We may offer a free trial period. If you do not cancel before the trial ends, your subscription will automatically begin and you will be charged according to your selected plan.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Transmit any harmful, offensive, or illegal content
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any portion of the Service
• Use the Service for any fraudulent or deceptive purpose

6. Intellectual Property

6.1 Our Property

The Service and its original content, features, and functionality are owned by Escape Room Studio and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 Your Content

You retain ownership of any content you upload, create, or store using the Service ("User Content"). By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your User Content solely for the purpose of providing and improving the Service.

6.3 Content Responsibility

You are solely responsible for your User Content and warrant that you have all necessary rights to grant the license described above. We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable.

7. Data and Privacy

We implement reasonable security measures to protect your data, but we cannot guarantee absolute security. You are responsible for maintaining backups of your important data.

8. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be unavailable due to:

• Technical issues or failures
• Force majeure events
• Third-party service disruptions

We are not liable for any damages resulting from Service unavailability.

9. Termination

9.1 By You

You may terminate your account at any time by canceling your subscription and deleting your account through the Service settings or by contacting support.

9.2 By Us

We may suspend or terminate your account immediately, without prior notice, if you violate these Terms or engage in fraudulent, illegal, or harmful activities. Upon termination, your right to use the Service will cease immediately.

9.3 Effect of Termination

Upon termination, we may delete your account and data. We are not obligated to retain your data after termination. You are responsible for exporting your data before account termination.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ESCAPE ROOM STUDIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless Escape Room Studio and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Service or violation of these Terms.
